These terms govern your access to and use of the Credana platform. Please read them carefully.
01. Introduction
Welcome to Credana.
These Terms of Service ("Terms") govern your access to and use of the Credana platform, website, onboarding systems, verification workflows, trust infrastructure systems, APIs, reports, dashboards, badges, verification pages, trust artifacts, request workflows, data processing systems, and related services (collectively, the "Services").
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.
If you use the Services on behalf of a business, organization, practice, professional entity, or other legal entity, you represent and warrant that you are authorized to bind that entity to these Terms.
02. Nature of the Services
Credana is a verification-based reputation intelligence and trust infrastructure platform. Credana operates as a structured trust, verification, and reputation intelligence system designed to process transaction-linked experience records, operational metadata, verification signals, identity-linkage signals, request lifecycle records, and related analytical inputs.
Credana may generate:
- verification records
- trust indicators
- reputation intelligence outputs
- confidence layers
- risk indicators
- probabilistic analytical outputs
- structured summaries
- reports
- trust artifacts
- verification pages
- badges
- benchmarks
- percentile classifications
- model-based outputs
Credana is not:
- an open public review marketplace
- a consumer complaint forum
- a public publishing platform
- a rating website
- a legal adjudicator
- a guarantee of service quality
- a credit bureau
- a background check provider
- an employment screening provider
- an insurer
- a medical provider
- an investment advisor
- a substitute for independent diligence
Credana does not operate as an unrestricted public commentary platform. Visibility, accessibility, and distribution of records, outputs, reports, trust artifacts, verification pages, and related materials may be controlled, permissioned, contextualized, segmented, restricted, or governed according to system rules, authorization levels, integrity controls, contractual relationships, legal obligations, operational policies, or platform governance requirements.
Credana outputs reflect structured signals available within the Credana system environment and should not be interpreted as universal, exhaustive, complete, or definitive representations of any person, business, organization, professional, practice, or service provider.
03. Eligibility
You must be at least eighteen (18) years old and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.
04. Accounts and Business Use
Certain Services may require onboarding, registration, activation, identity verification, payment, authorization, or account approval. You agree to provide accurate, current, complete, and authorized information and to maintain such information appropriately.
You are responsible for:
- maintaining confidentiality of account credentials
- restricting access to your account
- activities occurring under your account
- ensuring submitted information is lawful and authorized
- ensuring use of the Services complies with applicable law and contractual obligations
- ensuring that any representatives using the Services are properly authorized
Credana may deny, suspend, or restrict access where authorization, account integrity, payment status, identity linkage, or platform integrity cannot be reasonably confirmed.
05. Verified Experience Records
Credana maintains verification-linked experience records associated with service interactions. Verification signals may include:
- receipts
- invoices
- payment confirmations
- service records
- request tokens
- delivery records
- operational metadata
- identity signals
- transaction linkage
- system-generated workflow records
- third-party integration records
- submission timestamps
- communication delivery events
"Verified" means a record has been linked to one or more verification signals recognized by the Credana system. Verified does not mean Credana independently validates every subjective statement, opinion, characterization, or experience narrative submitted by a respondent.
Entity association, identity linkage, transaction matching, relationship mapping, and service attribution may rely on automated, probabilistic, rule-based, or metadata-driven systems and may be affected by incomplete, delayed, conflicting, inaccurate, unavailable, or corrupted information.
Credana may reclassify, suppress, annotate, exclude, or adjust the treatment of records where entity linkage, verification confidence, data quality, fraud risk, or operational integrity requires correction or containment.
06. Append-Only Records and Audit Integrity
To preserve auditability, traceability, reproducibility, integrity, and operational defensibility, Credana may maintain:
- append-only records
- immutable audit logs
- verification histories
- request lifecycle records
- delivery logs
- fraud review records
- report histories
- scoring histories
- dispute histories
- trust artifact histories
- operational event records
- model lineage records
- consent records
- legal acceptance records
- data processing histories
Historical records may be retained for purposes including:
- fraud prevention
- operational integrity
- legal defense
- dispute resolution
- compliance
- traceability
- model reproducibility
- governance
- evidentiary preservation
- platform security
- system reconciliation
Credana may preserve immutable historical records while modifying, suppressing, annotating, contextualizing, reclassifying, excluding, restricting, segmenting, permissioning, or limiting records from specific outputs, visibility layers, reports, benchmarks, badges, trust artifacts, scoring systems, or distributions.
Credana is under no obligation to publish, maintain, continue displaying, distribute, preserve public visibility of, or provide continued access to any report, score, output, badge, trust artifact, verification page, benchmark, or historical output.
07. Controlled Visibility and Distribution Governance
Credana may control how, when, where, and to whom outputs, records, badges, reports, verification pages, trust artifacts, or other materials are displayed or distributed. Credana may restrict visibility based on:
- account status
- payment status
- verification status
- confidence level
- integrity review
- legal risk
- platform rules
- contractual rights
- data quality
- regulatory exposure
- dispute status
- fraud indicators
- operational governance requirements
Credana may modify, disable, suppress, remove, revoke, expire, or limit access to outputs, trust artifacts, verification pages, or reports without obligation to preserve continued public display.
08. User Responsibilities
You agree not to:
- submit false, fabricated, manipulated, or misleading information
- submit fraudulent transaction data
- impersonate another person or entity
- manipulate verification workflows
- manipulate scoring outcomes
- interfere with trust calculations
- pressure, coerce, or improperly influence respondents
- misuse request links or verification tokens
- exploit platform vulnerabilities
- scrape or bulk extract platform data without authorization
- reverse engineer the Services
- misuse trust artifacts or badges
- misrepresent verification status
- display revoked or expired trust artifacts
- interfere with operational integrity
- use the Services for unlawful, deceptive, defamatory, abusive, discriminatory, misleading, harassing, or exploitative purposes
- use the Services in a manner that creates legal, regulatory, reputational, or operational risk for Credana or others
You are solely responsible for the legality, authorization, and accuracy of information submitted through the Services.
09. Guest and Respondent Submissions
Certain respondents may submit experience records without creating a full Credana account. By submitting information through a Credana workflow, request link, QR flow, SMS flow, email flow, verification flow, or related system process, the respondent represents that:
- the submission relates to a real service interaction
- the information is truthful to the best of the respondent's knowledge
- the respondent is not intentionally submitting false, manipulated, abusive, fraudulent, or misleading information
- the respondent is authorized to submit the information provided
Credana reserves the right to reject, suppress, quarantine, flag, exclude, invalidate, annotate, reclassify, or restrict submissions that appear fraudulent, duplicative, manipulated, abusive, irrelevant, suspicious, low-confidence, or non-compliant.
10. Identity Verification and Integrity Controls
Credana may use integrity and verification measures including:
- email verification
- phone verification
- one-time passcodes
- tokenized links
- transaction matching
- metadata analysis
- anomaly detection
- fraud screening
- rule-based analysis
- AI-assisted processing
- manual review
- workflow reconciliation
- integration-based verification
- confidence scoring
You authorize Credana to use these measures to preserve operational integrity, fraud resistance, verification reliability, and trust system stability.
Credana is not obligated to disclose internal fraud detection logic, anomaly thresholds, scoring rules, weighting mechanisms, or integrity controls where disclosure may compromise platform security, model integrity, or anti-manipulation systems.
11. Scoring, Reports, and Intelligence Outputs
Credana may generate:
- Experience Index
- Stability Index
- confidence layers
- risk indicators
- analytical summaries
- trust classifications
- reports
- trust artifacts
- badges
- benchmarks
- percentile outputs
- verification pages
- probabilistic computational outputs
Outputs are model-based, computational, probabilistic, inferential, confidence-weighted, version-controlled, dependent on available system data, subject to verification weighting, subject to anomaly controls, subject to methodological revision, and subject to change over time.
Outputs are not guarantees, warranties, definitive factual determinations, legal findings, employment decisions, lending decisions, insurance decisions, medical advice, legal advice, investment advice, or definitive representations of character, conduct, reputation, fitness, competence, or quality.
Credana outputs are intended as one structured informational input among many and are not intended to serve as the sole basis for legal, medical, employment, lending, insurance, housing, licensing, credentialing, investment, or other regulated decisions.
12. Regulated Decisioning Restrictions
You may not use Credana outputs as the sole basis for decisions involving:
- employment
- hiring
- promotion
- termination
- lending
- credit eligibility
- insurance eligibility
- housing eligibility
- medical treatment
- licensing
- credentialing
- legal determinations
- adverse consumer decisions
- any regulated decision requiring independent legal, professional, or statutory compliance
You are solely responsible for determining whether your use of the Services is subject to any industry-specific, privacy, employment, healthcare, consumer reporting, financial services, insurance, or other regulatory requirements.
Credana does not authorize use of the Services as a consumer report, employment screening report, credit report, medical record, insurance underwriting report, or legally determinative risk score unless expressly agreed in a separate written agreement and supported by required compliance controls.
13. Healthcare, Professional Services, and Sensitive Contexts
Where the Services are used by or in connection with healthcare, legal, financial, or other professional service providers, the Services remain reputation intelligence and verification infrastructure only.
Credana does not provide medical advice, clinical judgment, diagnosis, treatment recommendations, legal advice, financial advice, or regulated professional opinions.
Users are responsible for ensuring that submitted data does not include unnecessary sensitive information and that any required consents, notices, authorizations, or legal bases have been obtained before submitting data to Credana. Credana does not request protected health information unless specifically required for a lawful and authorized platform purpose under an applicable agreement.
14. Model Governance and Methodology Controls
Credana may update scoring methodologies, weighting systems, verification rules, anomaly thresholds, classification systems, confidence layers, trust calculations, report structures, operational logic, model governance mechanisms, model calibration systems, and output formats.
Historical outputs may remain associated with prior model versions for auditability, reproducibility, lineage tracking, comparison, and governance purposes.
Credana may maintain confidential its methodologies, weighting systems, anomaly thresholds, fraud detection systems, confidence calculations, governance rules, operational heuristics, model calibration systems, risk detection logic, and internal integrity controls. Credana is not required to publicly disclose such systems.
15. AI and Automated Processing
Credana may use automated systems, AI-assisted tools, machine learning models, rule-based systems, and other computational processes to support:
- receipt extraction
- invoice parsing
- document analysis
- verification support
- anomaly detection
- fraud detection
- categorization
- scoring support
- report drafting
- summarization
- benchmark generation
- operational classification
Automated systems may produce incomplete, inaccurate, delayed, or imperfect results. Not every output is manually reviewed. Credana may combine automated processing with metadata, structured rules, identity signals, verification workflows, confidence thresholds, and human review.
16. Fraud, Manipulation, and Enforcement Rights
Credana reserves the right to:
- reduce confidence weighting
- suppress outputs
- exclude records from scoring
- quarantine suspicious activity
- invalidate outputs
- revoke trust artifacts
- revoke badges
- restrict visibility
- suspend accounts
- terminate access
- preserve evidence
- investigate abuse
- reclassify records
- invalidate verification status
- exclude entities from benchmarks
- restrict distribution
- block request workflows
- refer matters for legal review or enforcement
Credana may take enforcement action where fraud, manipulation, abuse, integrity risk, operational risk, reputational risk, regulatory exposure, or legal risk is suspected.
17. Disputes, Corrections, and Record Treatment
Credana may provide processes for disputes, corrections, flags, appeals, or review requests. A dispute or correction request does not guarantee deletion, modification, removal, suppression, rescoring, or republication of any record or output.
Credana may:
- make no change
- correct metadata
- correct entity linkage
- merge duplicate records
- add dispute notation
- suppress a record from outputs
- exclude a record from scoring
- flag fraud
- revoke trust artifacts
- update reports
- preserve record history
- place records under review
- maintain legal hold
Credana may preserve historical records for audit, dispute, compliance, fraud prevention, system integrity, and legal defense purposes even where current visibility, output treatment, or scoring treatment changes.
18. Data Rights and License
You retain rights in information you lawfully submit, subject to the rights granted under these Terms. You grant Credana a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, reproduce, format, transmit, display, and use submitted information for purposes including verification, fraud prevention, trust calculations, scoring, benchmarking, analytics, report generation, audit logging, trust artifact generation, operational governance, model development, system improvement, integrity preservation, dispute resolution, compliance, security, and customer support.
Credana may use aggregated, anonymized, de-identified, statistical, or derived information for benchmarking, analytics, operational intelligence, industry analysis, model calibration, trust system improvement, fraud detection, system governance, and research and development.
19. Privacy and Data Protection
Credana processes personal information in accordance with its Privacy Policy. Depending on your location and the nature of your use, you may have rights related to access, correction, deletion, portability, objection, restriction, or withdrawal of consent.
Some records may be retained where necessary for legal compliance, audit integrity, fraud prevention, dispute resolution, security, operational integrity, legal defense, or model reproducibility.
20. Data Security
Credana uses reasonable administrative, technical, and organizational safeguards designed to protect information. No system is completely secure. Credana does not guarantee absolute security, uninterrupted access, lossless preservation, or error-free storage. You are responsible for maintaining reasonable security controls over your account, credentials, systems, integrations, and users.
21. Payments and Billing
Certain Services require payment. By purchasing Services, you authorize Credana and its payment processor to charge applicable fees. Unless otherwise expressly agreed in writing:
- setup fees are non-refundable
- subscription fees are billed in advance
- subscriptions may renew automatically until canceled
- taxes may apply
- usage already consumed is non-refundable
- subscription fees, onboarding fees, setup fees, and usage fees are non-refundable unless otherwise agreed in writing
Failure to pay may result in suspension, restricted access, termination, collections activity, revocation of trust artifacts, suppression of outputs, or enforcement action. Improper chargebacks may result in account suspension, collections activity, legal enforcement, or termination.
22. Subscription Renewal and Cancellation
Subscriptions may automatically renew unless canceled before the renewal date. Cancellation stops future renewal charges but does not require refund of fees already paid, unless otherwise required by applicable law or agreed in writing. Credana may continue to preserve audit records, historical outputs, verification histories, legal acceptance records, and trust artifact histories after cancellation.
23. Suspension and Termination
Credana may suspend, restrict, terminate, suppress, or limit access to the Services at any time if these Terms are violated, fraud or abuse is suspected, legal or operational risk exists, payment fails, platform integrity may be compromised, trust artifacts are misused, system manipulation is detected, regulatory exposure exists, data quality risk exists, or user authorization cannot be confirmed.
Sections relating to audit logs, data rights, dispute resolution, trust artifacts, operational records, disclaimers, indemnification, limitation of liability, enforcement, confidentiality of methods, model governance, and record retention shall survive termination.
24. Trust Artifacts and Badge Usage
Credana may issue badges, verification pages, reports, public trust pages, verification links, claim embeds, score displays, or related trust artifacts. Credana grants a limited, revocable, non-transferable license to display approved trust artifacts only while the account remains active, compliant, authorized, operationally eligible, current on payment, in good standing, and not under unresolved integrity review.
You may not:
- modify trust artifacts
- crop or alter trust displays
- misrepresent trust status
- imply guaranteed outcomes
- imply universal endorsement
- display expired badges
- display revoked trust artifacts
- separate trust artifacts from required disclosures
- use trust artifacts deceptively
- use trust artifacts after suspension or termination
- use trust artifacts in a misleading context
- imply that Credana endorses all services, outcomes, personnel, or business practices
Credana may revoke, disable, invalidate, suppress, expire, remove, or restrict trust artifacts at any time.
25. Intellectual Property
The Services, including software, workflows, interface elements, platform logic, reports, trust artifact formats, scoring systems, model structures, documentation, branding, designs, text, graphics, and related materials, are owned by Credana or its licensors. Except as expressly permitted, you may not copy, modify, distribute, sell, sublicense, exploit, reverse engineer, or create derivative works from the Services. You may use approved Credana trust artifacts only as expressly authorized under these Terms or a separate written agreement.
26. Confidentiality of Platform Methods
Credana may treat internal methodologies, scoring logic, fraud detection systems, anomaly thresholds, confidence calculations, risk rules, weighting logic, model calibration systems, operational controls, and platform governance mechanisms as confidential or proprietary. You agree not to attempt to discover, reverse engineer, manipulate, reproduce, or exploit such systems.
27. Third-Party Services
Credana may integrate with third-party providers including providers for hosting, payments, messaging, analytics, AI-assisted processing, storage, communications, CRM, customer support, fraud detection, security, and operational infrastructure.
Credana is not responsible for third-party systems, services, uptime, availability, security, policies, or data practices. Your use of third-party services may be subject to separate terms and policies.
28. Platform Evolution and Service Changes
Credana may expand, automate, replace, discontinue, restructure, revise, or modify portions of the Services, workflows, methodologies, outputs, trust artifacts, operational systems, visibility layers, or verification systems over time. Credana does not guarantee uninterrupted preservation, accessibility, continuity, or perpetual availability of reports, outputs, verification pages, badges, historical records, benchmarks, or trust artifacts.
29. No Fiduciary Duty
Credana does not undertake fiduciary obligations, investigative obligations, monitoring obligations, verification obligations, professional duties, or special duties beyond operation of the Services as expressly described. No relationship created through the Services shall be construed as fiduciary, agency, partnership, employment, joint venture, medical, legal, financial advisory, or insurance relationship.
30. No Professional Advice
The Services and outputs are provided for informational and operational purposes only. They do not constitute legal advice, medical advice, clinical advice, financial advice, investment advice, insurance advice, employment advice, tax advice, or compliance advice. You should consult qualified professionals before making decisions requiring professional judgment.
31. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDANA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, PERFORMANCE, COMPLETENESS, SECURITY, AND ERROR-FREE OPERATION.
Credana does not guarantee uninterrupted, error-free, secure, accurate, complete, or continuously available operation of the Services. Credana does not guarantee any business, financial, legal, reputational, customer, operational, conversion, compliance, or professional outcome.
32. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CREDANA SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, REPUTATIONAL HARM, BUSINESS INTERRUPTION, LOSS OF BUSINESS OPPORTUNITY, OR LOSS OF EXPECTED BENEFITS ARISING OUT OF OR RELATED TO THE SERVICES.
Credana's total liability shall not exceed the amounts paid by you to Credana during the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply.
33. Indemnification
You agree to defend, indemnify, and hold harmless Credana and its affiliates, officers, directors, employees, contractors, licensors, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the Services, submitted information, fraud or misconduct, misuse of trust artifacts, violation of these Terms, infringement of rights, unlawful conduct, regulatory exposure caused by your actions, failure to obtain required consents, misuse of outputs in regulated decisions, or violation of applicable law.
34. Informal Dispute Resolution
Before filing any formal claim, you agree to first contact Credana at the legal email address in the Contact section below and provide a written notice describing the dispute, requested relief, and supporting facts. The parties shall attempt in good faith to resolve the dispute informally for thirty (30) days after receipt of the notice. Either party may seek emergency injunctive relief where necessary to prevent unauthorized use, misuse of trust artifacts, infringement, security risk, platform abuse, or irreparable harm.
35. Arbitration Agreement
Except where prohibited by law or where emergency injunctive relief is sought, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration on an individual basis. The arbitration shall be conducted in Florida, unless the parties agree otherwise, under rules selected by Credana and consistent with applicable law. The arbitrator shall have authority to resolve disputes regarding interpretation, applicability, enforceability, and formation of this arbitration agreement. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
36. Class Action Waiver
To the maximum extent permitted by law, you and Credana agree that disputes shall be brought only on an individual basis. You and Credana waive the right to participate in class actions, collective actions, consolidated actions, representative actions, or private attorney general actions. Unless both parties agree in writing, no arbitrator or court may consolidate claims from multiple parties or preside over any form of class, collective, consolidated, or representative proceeding.
37. Venue and Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. For claims not subject to arbitration, the parties consent to exclusive jurisdiction and venue in the state or federal courts located in Florida, unless prohibited by applicable law.
38. Limitation Period
To the maximum extent permitted by law, any claim arising out of or relating to the Services or these Terms must be brought within one (1) year after the claim accrues. Claims filed after that period are permanently barred, unless applicable law requires a longer period.
39. Changes to These Terms
Credana may update these Terms from time to time. Updated Terms become effective when posted or when otherwise communicated. Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms. Where required by law, Credana may provide additional notice or request renewed acceptance.
40. Severability
If any provision of these Terms is found unenforceable, invalid, or unlawful, the remaining provisions shall remain in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable, where permitted by law.
41. Assignment
You may not assign or transfer these Terms or your rights under them without Credana's prior written consent. Credana may assign or transfer these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction, or by operation of law.
42. Entire Agreement
These Terms, together with any referenced policies, order forms, billing terms, privacy policy, acceptable use policy, verification and scoring disclosure, data processing addendum, and trust artifact license terms, constitute the entire agreement between you and Credana regarding the Services.
